We have appointed a data protection officer in our company to deal with all questions relating to the processing of your personal data and the exercise of your rights. You can reach her at the following contact details: fors.earth, Unterer Anger 3, D - 80331Munich, Germany, e-mail: datenschutz@fors.earth.
3. Which of your data is processed by us?
We process the data you send us in connection with your application solely to assess your suitability for the position (or other open positions in our companies, if applicable) and to carry out the application and selection process to the extent necessary to decide whether to establish an employment relationship with us.
4. What is the legal basis for this?
The legal basis for the processing of your personal data in this application procedure is primarily Section 26 BDSG in the version applicable as of 25.05.2018. According to this, the processing of data required in connection with the decision on the establishment of an employment relationship is permissible. Should the data be required for legal prosecution after the conclusion of the application process, if applicable, data processing may be carried out on the basis of the requirements of Art. 6 DSGVO, in particular to safeguard legitimate interests pursuant to Art. 6 (1) lit. f) DSGVO. Our interest then consists in the assertion or defense of civil claims in connection with your application.
5. What categories of data do we process?
We process data related to your application. This may be general data about you (such as your name, address and contact details), information about your professional qualifications and school education or information about professional training, or other information that you provide to us in connection with your application.
6. How long will the data be stored?
Your personal data will initially be stored for the duration of the application process and beyond that for 6 months, after which it will be deleted. Deviating from this, our confirmation of receipt to you as a commercial letter is stored for six years and then deleted. We therefore continue to store the data that is also contained in the confirmation of receipt of your application with us, in particular your name, the contact details you provided, the date of your application and the title of the position for which you applied. This extended storage serves to fulfill legal obligations due to statutory retention periods and is based on Article 6 para. 1 lit. c) DSGVO, § 257 HGB. If your personal data is required beyond this (for example, in connection with the assertion or defense of civil law claims in connection with your application), it will be deleted as soon as the further storage of the data is no longer necessary for these purposes. In this case, the storage is based on Art. 6 para. 1 lit. f) DSGVO. In the event that you have agreed to further storage of your personal data, we will transfer your data to our applicant pool. There, the data will be deleted after two years. If you enter into an employment relationship with us after completion of the application and selection process, the data will be transferred to our personnel information system for the purpose of implementing the employment relationship.
7. To which recipients will the data be passed on?
We treat your applicant data with the utmost confidentiality. After receipt of your application, your application documents will be viewed by the persons involved in the application process. Suitable applications are forwarded to the appropriate person in the specialist department. As a matter of principle, only those persons in the company who need to access your data for the proper conduct of our application process will have access to it. Your data will not be passed on to third parties or transferred to third countries.
8. Where is the data processed?
The data is stored in the Microsoft Cloud. Technical organizational measures are taken to ensure the highest possible level of security for personal data.
9. What rights do you have?
You have the right to obtain information about your personal data processed by us, in particular about the stored data and their processing purposes (Art. 15 DSGVO). Furthermore, you have a right to correct incorrect or complete incomplete data (Art. 16 DSGVO), erasure of any data processed unlawfully or no longer required (Art. 17 DSGVO), restriction of processing (Art. 18 DSGVO), objection to processing (Art. 21 DSGVO), as well as a right to data transfer, provided that the processing is based on consent or is carried out for the performance of a contract or with the aid of automated processes (Art. 20 DSGVO). However, these rights cannot be exercised retroactively and may have an impact on the application and selection process. To exercise your legal rights, you can contact us or our data protection officer at any time using the data mentioned in points 1. and 2.
